Welcome to FamilyPet AI. These Terms of Service ("Terms") govern your access to and use of the FamilyPet AI mobile application (the "App") operated by FamilyPet AI ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you are at least 13 years old. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

• You must create an account to use certain features of the App. You agree to provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to notify us immediately at support@familypetai.com if you suspect unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of Service

FamilyPet AI allows users to:

• Upload photos of their pets for AI-powered health analysis.
• Create and manage pet profiles (name, species, breed, age, weight).
• View health scan history and track conditions over time.
• Receive product recommendations via affiliate links to third-party retailers.
• Identify pet breeds via photo analysis.

4. Important Medical Disclaimer

THE AI HEALTH ANALYSIS PROVIDED BY FAMILYPET AI IS FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. IT IS NOT A SUBSTITUTE FOR PROFESSIONAL VETERINARY ADVICE, DIAGNOSIS, OR TREATMENT.

Our AI assessments are generated by artificial intelligence technology and are designed to help you identify potential health concerns in your pets. These assessments:

• Are NOT veterinary diagnoses.
• Should NOT be used as the sole basis for any health-related decisions regarding your pet.
• Do NOT replace regular veterinary checkups and professional medical care.
• May not detect all conditions, and accuracy may vary based on image quality and the nature of the condition.

Always consult a licensed veterinarian for diagnosis, treatment, and medical advice for your pet. If your pet is experiencing a medical emergency, contact your veterinarian or an emergency animal hospital immediately.

By using the App, you acknowledge and agree that FamilyPet AI is not liable for any health outcomes, injury, or harm to your pet resulting from reliance on the App's AI analysis or recommendations.

5. Subscriptions and Payments

5.1 Free and Premium Plans

The App offers a free tier with limited features and a premium subscription plan at $4.99 per month that provides additional features including unlimited scans, unlimited pet profiles, full health history, and priority AI analysis.

5.2 Billing

• Premium subscriptions are billed through the Apple App Store or Google Play Store, depending on your device.
• Subscription management and payment processing are handled by RevenueCat in conjunction with the applicable app store.
• Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

5.3 Cancellation and Refunds

• You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings.
• Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the period you have paid for.
• Refunds are subject to the policies of Apple or Google, as applicable. We do not process refunds directly.

5.4 Price Changes

We reserve the right to change subscription pricing. Any price changes will be communicated in advance and will apply to the next billing cycle after the change.

6. User Content

6.1 Your Content

You retain ownership of the photos and information you upload to the App ("User Content"). By uploading User Content, you grant FamilyPet AI a non-exclusive, worldwide, royalty-free license to use, store, process, and transmit your User Content solely for the purpose of providing and improving the App's services, including transmitting images to our AI analysis provider.

6.2 Content Restrictions

You agree not to upload content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Infringes on any third party's intellectual property or privacy rights.
• Contains malware, viruses, or other harmful code.
• Depicts animal abuse or cruelty.
• Is not a photo of a pet or animal (the App is designed for pet health analysis only).

6.3 Content Removal

We reserve the right to remove any User Content that violates these Terms without prior notice.

7. Affiliate Links and Third-Party Products

The App may display product recommendations with affiliate links to third-party retailers, including Amazon and Chewy. Please note:

• We may earn a commission from purchases made through these affiliate links at no additional cost to you.
• We do not manufacture, sell, or warrant any third-party products. Product purchases are governed by the respective retailer's terms and policies.
• Product recommendations are generated based on your pet's scan results and profile and are for informational purposes only. We do not guarantee the suitability or effectiveness of any recommended product.

8. Intellectual Property

• The App, including its design, features, code, graphics, logos, and AI technology, is owned by FamilyPet AI and is protected by intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
• You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works based on the App or any part thereof.

9. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to the App, its servers, or any connected systems.
• Interfere with or disrupt the App's functionality or the servers and networks connected to it.
• Use automated means (bots, scrapers, etc.) to access the App or extract data.
• Misrepresent the App's AI health analysis as professional veterinary advice or diagnosis.
• Create multiple accounts to circumvent free tier limitations.
• Use the App to harm or exploit animals in any way.

10. Push Notifications

With your consent, we may send push notifications to your device regarding scan results, health reminders, and App updates. You can disable push notifications at any time through your device settings.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FAMILYPET AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill.
• Any harm, injury, or death of any pet or animal resulting from use of or reliance on the App's AI analysis, recommendations, or any information provided through the App.
• Costs of veterinary care or treatment.
• Any errors or inaccuracies in AI health assessments.
• Unauthorized access to or alteration of your data.
• Any third-party products purchased through affiliate links.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

12. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure.
• AI health assessments will be accurate, complete, or reliable.
• The App will meet your specific requirements.
• Any defects in the App will be corrected.

13. Indemnification

You agree to indemnify, defend, and hold harmless FamilyPet AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your use of the App.
• Your violation of these Terms.
• Your violation of any third-party rights.
• Any User Content you upload to the App.

14. Termination

• You may stop using the App and request account deletion at any time by contacting support@familypetai.com.
• We may suspend or terminate your access to the App at any time, with or without cause, with or without notice.
• Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including Sections 4, 6.1, 11, 12, 13, 16, and 17) will survive.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App and updating the "Last updated" date. Your continued use of the App after any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the App.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.

17. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and FamilyPet AI regarding the App.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
• Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

18. Apple and Google App Store Terms

If you downloaded the App from the Apple App Store or Google Play Store, the following additional terms apply:

• These Terms are between you and FamilyPet AI, not with Apple Inc. or Google LLC. Apple and Google are not responsible for the App or its content.
• Apple and Google have no obligation to provide maintenance or support services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google for a refund of the purchase price (if any). To the maximum extent permitted by law, Apple and Google have no other warranty obligation with respect to the App.
• Apple and Google are not responsible for addressing any claims relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.
• Apple and Google, and their subsidiaries, are third-party beneficiaries of these Terms and may enforce these Terms against you.
